Agreement to Terms
By accessing and using the Gillespie Insurance Agency website ("Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Site. We reserve the right to modify these Terms at any time, and such modifications shall be effective immediately upon posting on the Site.
Use of Website
You agree to use this Site only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the Site. You may not use the Site:

Communications Consent — Calls, Texts & Voicemails
By submitting your telephone number through any form on this Site — including quote request forms, contact forms, or any other means — and checking any consent checkbox or otherwise affirmatively consenting, you expressly agree, pursuant to the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, and applicable state laws, that Gillespie Insurance Agency and its authorized agents may contact you at the telephone number you provide using:
- Automated telephone dialing systems (ATDS) — autodialed calls made using equipment that can store or produce telephone numbers to be called using a random or sequential number generator
- Artificial or prerecorded voice messages — including recorded sales or informational messages
- Ringless voicemail (RVM) — messages delivered directly to your voicemail inbox without causing your phone to ring
- SMS and MMS text messages — automated text messages regarding your insurance inquiries, quotes, policy renewals, and account updates
- Live telephone calls from our licensed insurance agents
Your consent to receive automated calls, texts, and voicemails is not a condition of purchasing any insurance product or service from us.
You represent and warrant that you are the account holder of the telephone number you provide, or that you have the account holder's permission to provide that number and grant consent on their behalf.
Text Message (SMS/MMS) Terms
By opting in to receive text messages from Gillespie Insurance Agency, you agree to the following:
- Program description: We may send text messages regarding insurance quotes, policy renewals, payment reminders, appointment confirmations, and other account-related communications.
- Message frequency: Message frequency varies based on your account activity and interactions with our agency. You may receive multiple messages per month.
- Rates: Message and data rates may apply. Charges are billed by your mobile carrier. Gillespie Insurance Agency is not responsible for charges incurred from your mobile carrier.
- Supported carriers: Service is available on most major U.S. carriers. Not all mobile phone carriers are covered or provide all services.
How to Opt Out of Text Messages
You may opt out of text messages at any time by replying STOP to any text message you receive from us. You will receive one final confirmation message confirming your opt-out. After opting out, you will not receive any further automated text messages from us unless you re-opt in.

How to Opt Out of Automated Calls & Voicemails
You may revoke your consent to receive automated telephone calls and ringless voicemails at any time by:
- Calling us at (315) 252-0694 and requesting to be placed on our internal do-not-call list
- Emailing us at info@giacny.com with "DO NOT CALL" in the subject line and including your name and phone number
- Writing to us at 177 North St, Auburn, NY 13021
We will process your opt-out request within a commercially reasonable time, not to exceed 30 days. Opting out of automated marketing calls will not prevent us from contacting you about your active policies, claims, or legally required notices.
National Do Not Call Registry
We comply with the National Do Not Call Registry maintained by the Federal Trade Commission (FTC). If your telephone number is registered on the National Do Not Call Registry, we will honor that registration and will not make unsolicited marketing calls to that number, except as permitted by law, including when:
- You have provided us with prior express written consent to receive such calls
- You have an established business relationship with us (as defined by applicable law)
- The call is otherwise permitted by applicable federal or state law
State-Specific Compliance
Gillespie Insurance Agency is licensed to write insurance in New York, Connecticut, Ohio, Pennsylvania, New Hampshire, Maine, Florida, Georgia, North Carolina, South Carolina, Arizona, Missouri, Vermont, and Tennessee. In addition to federal TCPA requirements, we comply with applicable state telemarketing, do-not-call, and consumer protection laws in each state where we operate, including but not limited to:
- New York: General Business Law § 399-z (Telemarketing regulations) and the New York State Do Not Call Registry
- Florida: Florida Telephone Solicitation Act (FTSA), Fla. Stat. § 501.059, which imposes additional restrictions on automated calls and texts to Florida residents
- All licensed states: Applicable state do-not-call laws and insurance department regulations governing agent solicitation practices
Residents of any state where we are licensed may contact us to exercise any rights available under their state's applicable laws.
